  • [01] GOVERNMENT ORAMS CASE

Government Spokesman Stephanos Stephanou has reiterated that the judgment of the British Court of Appeal on a property case involving a Greek Cypriot refugee and a British couple, over property in Turkish occupied Cyprus, is ``very important both from a political and a legal point of view.

Stephanou said that it is essential to make the most out of this judgment in the efforts undertaken by the Greek Cypriot side to defend the human rights of Cypriot citizens, pointing out however that the most important thing is to reach a solution of the Cyprus problem.

In reply to a question regarding statements by the Secretary-General`s Special Adviser on Cyprus, Alexander Downer in relation to the judgment, the Spokesman said that what is important is how we interpret and utilise this judgment.

He noted that as the President had said since day one, the government would make the most out of this particular judgment both politically and legally, expressing at the same time the view that a public discussion on how this judgment can be applied is not in the interest of Cyprus or the efforts to reach a political settlement, the property issue included.

The anomalous situation that exists today in Cyprus is a situation caused by the Turkish occupation, the de facto partition, the illegal action of Turkey in Cyprus and the violation of the international law, he said, referring to the continuing occupation of Cyprus northern part since the 1974 Turkish invasion.

Therefore, he concluded, what we need to do is to continue our intensive efforts to solve the Cyprus issue to end the occupation and unite the territory, the people, the institutions and the economy.

The Court of Appeal in London announced on Tuesday its judgment in the case Apostolides v Orams, deciding in favour of Apostolide in a final appeal. Following a decision of the Cyprus Court, the British Court decided that the couple Orams, who illegally owns land in Turkish occupied Lapithos belonging to Cypriot refugee Apostolides, should compensate him, deliver him up possession of the land and knock down the villa and fencing they had built.

President of the Republic Demetris Christofias and Turkish Cypriot leader Mehmet Ali Talat began UN-led direct negotiations in September 2008 with a view to reunify Cyprus, divided since the 1974 Turkish invasion.

They concluded the first round of three-day intensive negotiations and they will hold a second round on January 25, 27 and 27.
