[01] A state not honouring its undertaking to respect a judgement of the Court is at odds with the Council of Europe's fundamental principles

Asked by MPs what measures the Council of Europe will take so that the decision is implemented, the Chairman of the Council of Europe Committee of Ministers Mr Umberto Ranieri, said that it is yet too early to indicate exactly which measures the Committee will take. "This question will be examined at the Committee's next human rights meeting in December", he said.

Mr Ranieri stated that the Committee has not been informed of any payment or promise of payment within the immediate future.

"This poses a major problem for the Council of Europe. Acceptance of the Convention and the compulsory jurisdiction of the European Court of Human Rights have been basic requirements for membership of this organization since the 1980's," he said.

"A state not honouring its undertaking to respect a judgement of the Court is at odds with the Organisation's fundamental principles" he added.

Mr Ranieri stressed, "the Committee has indicated in the clearest terms its resolve to ensure that Turkey complies with the Courts' judgement in this case and pays the just satisfaction awarded to the applicant".

Titina Loizidou a Greek Cypriot refugee from Kyrenia had challenged Turkey's continuing denial of her right to peacefully enjoy and use her property.

The European Court of Human Rights had decided that because of the continuous violation of the applicant's human rights by Turkey and the consequent loss of the use of her property she was entitled to just satisfaction under Article 50 of the Convention".

[02] Russia will continue to support Cyprus's independence

In a congratulatory telegram to President Clerides on the occasion of the 40th anniversary of Cyprus' Independence, the President of the Russian Federation Mr Vladimir Putin stated his country's support for a just settlement of the Cyprus problem based on the United Nations Charter, the UN resolutions and the principles of international law.

A settlement in favour of all Cypriots would undoubtedly contribute to the establishment of security and stability in the Eastern Mediterranean, and the wider area, he added.
