  • [01] Contrôle de l'application du droit communautaire - rapport 1995

    La Commission européenne a présenté au Conseil et au Parlement européen son XIIIème rapport annuel sur le contrôle de l'application du droit communautaire pour l'année 1995. Le rapport annuel a pour point central l'analyse des procédures d'infraction traitées par la Commission, sur le fondement de l'article 169 du Traité, pendant l'année écoulée. La Commission a constaté une stabilité des cas d'infraction en 1995 comparé avec les années précédentes (1016 mises en demeure, 192 avis motivés, 72 saisines), mais les décisions prises, au total dans le domaine du droit communautaire, ont été très élevées (5068 décisions). Ce chiffre, jamais atteint auparavant, montre l'engagement de la Commission à accélérer les décisions sur les dossiers ouverts, décisions qui peuvent amener à clore l'affaire.

    [02] Procédures d'infraction: entraves à la libre prestation des services et liberté d'établissement

    Face à des obstacles à la libre prestation des services et à la liberté d'établissement, principes fondamentaux du marché unique, la Commission européenne a décidé d'envoyer des avis motivés (la deuxième étape de la procédure d'infraction en vertu de l'Article 169 de Traité CE) à la Belgique, à l'Italie (deux cas) et au Luxembourg. En effet, la Belgique interdit l'établissement dans son pays des entreprises de l'Espace Economique Européen; l'Italie oblige les résidents en Italie à payer des services intermédiaires (par exemple, assurances) fournis par des non-résidents à travers un intermédiaire agréé et réserve l'activité de consultant en matière de circulation routière aux ressortissants italiens ou aux résidents en Italie; et le Luxembourg stipule que les organismes de contrôle en matière d'inspection du travail doivent être établis au Grand-Duché. En l'absence d'une réponse satisfaisante dans un délai de 40 jours ouvrables suivant réception par l'Etat membre en question d'un avis motivé, la Commission pourrait saisir la Cour de justice.

    [03] Mutual recognition pacts with Australia and New Zealand will bring new trade benefits to Community exporters

    The European Union, Australia and New Zealand have initialled a mutual Recognition Agreement (MRA) on Conformity Assessment. This will deliver significant trade benefits to European industry by allowing conformity assessment (i.e. testing and certification) of exported products to be undertaken in Europe rather than having to be carried out in Australia and New Zealand. The agreements cover over three billion US $ (2.35 billion ECU) of EU exports to the two countries. For European companies exporting to Australia and New Zealand, the time and cost involved in having a product approved for placement on the market will be significantly reduced, and for customers in general there will be potentially lower prices and faster delivery without affecting consumer safeguards provided by regulatory controls presently in place.

    [04] Padraig Flynn says that the Social Chapter is not an agenda for legislation but represents a priority to collective bargaining

    Speaking today in Brussels to the EU Committee of the American Chamber of Commerce, Social Affairs Commissioner Padraig Flynn said that the Agreement on Social Policy and the Social Chapter does not provide an agenda for legislation but rather gives the social partners, at European level, an explicit role in EU decision-making. "This represents a priority to collective bargaining rather than legislation. The social partners can, if they wish, reach a collective bargaining agreement rather than resorting to legislation."

    [05] Hans van den Broek addressed meeting of European industry on Reconstruction of Bosnia-Herzegovina

    This morning, Hans van den Broek, Commissioner responsible i.a. for relations with Bosnia-Herzegovina, addressed a conference where representatives of European Industry discussed opportunities for short- and mid-term investments in Bosnia-Herzegovina. Particular reference was made to the US$ 1,800 million pledges registered on behalf of the international community, inter alia related to essential reconstruction efforts such as road and railroad improvement, housing and services rehabilitation, telecommunications and water, gas and electricity infrastructure. The Commissioner made an appeal to the industry to undertake action in terms of investments, which will contribute to the creation of stable political and economic conditions in Bosnia-Herzegovina.
