[01] La Commission envisage une action de l'UE dans le domaine de
l'indemnisation des victimes de la criminalité
L'Union européenne devrait-elle prendre des mesures pour améliorer
l'indemnisation des victimes de la criminalité ? Un Livre vert abordant
cette question a été adopté aujourd'hui par la Commission européenne. Il
lance une consultation publique sur la manière dont on pourrait établir une
norme minimale relative à l'indemnisation des victimes de la criminalité.
Une attention particulière est accordée aux situations transfrontalières,
dans lesquelles des personnes sont victimes de criminalité dans un Etat
membre autre que le leur. La Commission invite toutes les parties
intéressées à lui faire parvenir leurs observations au sujet du Livre vert
et décidera ensuite s'il y a lieu ou non de présenter une proposition
législative.
[02] Commission report highlights control weaknesses in EU fisheries
The European Commission has adopted a report on the monitoring of the
implementation of the Common Fisheries Policy (CFP) which identifies
weaknesses in Member States' control systems. This report, which covers the
period from 1996 to 2000, evaluates the effectiveness of the control
systems and activities of the Member States in ensuring compliance with CFP
measures such as the respect of fishing quotas (TACs) or fleet capacity
limits. "Undeniably, progress has been achieved. However, significant
problems remain. We need stronger resolve to put in place the necessary
controls. Member States have to commit the necessary resources. In its
Green Paper, the Commission stresses the need to seize the opportunity
offered by the forthcoming CFP review to explore new ways of improving
control arrangements. Otherwise, the CFP will suffer a fatal blow to its
credibility. I am determined to use this review to make control more
effective and equitable", Franz Fischler, Commissioner for Agriculture,
Rural Development and Fisheries said.
[03] Commission clears acquisition of Klöckner by Balli
The European Commission has cleared the proposed acquisition of German
metal distributor Klöckner & Co AG by UK-based commodities trader Balli
Group Plc. The operation does not give rise to any significant addition of
market shares and, therefore, does not raise any competition concerns.
[04] La Commission approuve la restructuration de l'entreprise commune
créée par Coca-Cola et Nestlé pour le thé et le café glacés
La Commission européenne a autorisé le projet de restructuration de Coca-
Cola Nestlé Refreshment Company (CCNR), entreprise commune créée par The
Coca-Cola Company et l'entreprise agro-alimentaire suisse, Nestlé SA, qui
existait déjà pour le thé et le café glacés. L'opération ne soulève aucun
problème de concurrence du fait de l'existence de concurrents puissants en
Europe comme Lipton (Unilever) ou San Benedetto, de la présence d'un
certain nombre d'autres marques locales et de l'absence d'obstacles à
l'entrée sur le marché concerné.
[05] Sécurité des compléments alimentaires : David Byrne se félicite de
l'accord politique intervenu au Conseil
Le Commissaire européen à la Santé et à la Protection des Consommateurs,
David Byrne, s'est félicité hier de l'accord politique intervenu au Conseil
sur la proposition de directive concernant les compléments alimentaires. Le
Conseil 'Marché intérieur, consommateurs et tourisme' a approuvé un texte
de compromis élaboré par la présidence belge, fondé en grande partie sur la
proposition initiale de la Commission. L'objectif est d'harmoniser les
règles nationales concernant la vente de compléments alimentaires sous la
forme de pilules et de gélules. En effet, celles-ci varient considérablement
d'un Etat membre à l'autre. Le texte proposé fixe des règles de sécurité
harmonisées pour les compléments alimentaires qui contiennent des vitamines
et des sels minéraux. Il exige que des limites maximales soient établies en
ce qui concerne l'apport en vitamines et en sels minéraux, sur la base
d'une évaluation scientifique des risques et de données relatives à
l'apport en vitamines et en sels minéraux provenant d'autres denrées
alimentaires. Il sera également tenu compte de ce qui est considéré comme
un apport adapté pour une personne moyenne. Les étiquettes donneront aux
consommateurs des informations détaillées concernant la teneur en vitamines
et en sels minéraux et concernant la consommation journalière, y compris un
avertissement sur les risques liés à un dépassement de la dose recommandée
par le fabricant. Le Conseil devrait arrêter une position commune d'ici peu
et procéder à l'adoption finale une fois que le Parlement européen aura
terminé sa deuxième lecture.
[06] Selling financial services by mail, telephone and the Internet : David
Byrne and Frits Bolkestein welcome political agreement in the Council
European Commissioners David Byrne (Health and Consumer Protection) and
Frits Bolkestein (Internal Market) yesterday welcomed the breakthrough in
the Council of Ministers on the proposed Directive for the distance selling
of financial services. The Internal market, Tourism and Consumer Affairs
Council reached a political agreement on common rules for selling contracts
for credit cards, investment funds, pension plans, etc. to consumers by
phone, fax or internet. Its main features are (1) the prohibition of
abusive marketing practices seeking to oblige consumers to buy a service
they have not solicited ("inertia selling") ; (2) rules to restrict other
practices such as unsolicited phone calls and e-mails ("cold calling" and
"spamming") ; (3) an obligation to provide consumers with comprehensive
information before a contract is concluded ; and (4) a consumer right to
withdraw from the contract during a cool-off period - except in cases where
there is a risk of speculation. The newly agreed standards are in line with
those already applicable to all other retail sectors. The Council is now to
adopt its Common Position on the proposed Directive shortly, and will
proceed with its final adoption once the European Parliament will have
concluded its second reading on the proposal.
[07] Journée mondiale du cœur : David Byrne met en garde contre l'ampleur
croissante du problème de l'obésité en Europe
Le Commissaire européen David Byrne, chargé de la santé et de la protection
des consommateurs, a exprimé son soutien à la Journée mondiale du cœur, qui
se déroulera le 30 septembre prochain. Les maladies cardio-vasculaires
constituent la première cause de mortalité pour la majorité de la
population. Dans l'Union européenne, les maladies cardiaques ischémiques -
en particulier l'infarctus myocardique aigu - sont celles qui font le plus
grand nombre de victimes. Cependant, un mode de vie sain a normalement un
impact important sur la prévention des problèmes cardiaques. La Fédération
mondiale du cœur et le European Heart Network (Réseau européen du cœur -
EHN) mettent en garde contre le fait que l'obésité deviendra prochainement
un facteur dominant de maladie cardio-vasculaire. Selon David Byrne :
"L'obésité ne cesse de s'accentuer au sein de l'UE, à la fois chez les
enfants et chez les adultes. En voici deux illustrations : selon les
chiffres les plus récents, en Irlande, un adulte sur dix est obèse. En
Angleterre, cette proportion passe à près de un sur cinq. Il devient donc
de plus en plus important de promouvoir un régime alimentaire sain." La
Commission travaille sur les domaines d'activités suivants: législation
dans le domaine alimentaire, développement d'une politique communautaire
sur la nutrition et étude de la nutrition dans le nouveau programme de
santé publique.
[08] Afghanistan crisis : Commission confirms euro 4 million in emergency
aid
The European Commission today released details of its emergency decision to
allocate a further euro 4 million for the crisis in Afghanistan. The funds,
managed by the Humanitarian Aid Office (ECHO), are being deployed in
support of the relief efforts of the United Nations High Commission for
Refugees (UNHCR), the World Food Programme (WFP) and the International
Committee of the Red Cross (ICRC). This financing decision comes on top of
the euro 23.3 million in humanitarian aid already provided this year for
Afghanistan and for Afghan refugees in neighbouring countries, bringing the
total so far in 2001 to euro 27.3 million. This aid will be channeled
through ECHO which comes under the responsibility of Commissioner Poul
Nielson.
[09] Import ban of ruminants from south-east Europe due to bluetongue
The European Commission has adopted a decision to ban the imports of live
animals and their semen, embryos and ova of the bluetongue susceptible
species (sheep, goats, cattle and wild ruminants) originating from or
transiting through Albania, Bulgaria, the Former Yugoslav Republic of
Macedonia and the Federal Republic of Yugoslavia. Similar restrictions are
also in place in the areas of the European Union where this disease occurs
(Greece, the Balearics, Corsica and some areas in Italy). The new decision
has been taken after outbreaks of bluetongue have been confirmed recently
in Bulgaria at the border with the Republic of Yugoslavia and in Greece in
the vicinity of Albania and the Former Yugoslavian Republic of Macedonia.
Bluetongue is an easy-spreading viral disease of domestic and wild
ruminants transmitted by insects. It is not known to affect humans. For

[10] European standardisation : harnessing the power of the market to
deliver on public policy aims
The EU's market-led standardisation model is delivering the regulatory
flexibility we need to keep pace with technological change, encourage
innovative entrepreneurs, sustain the internal market's vitality, and duly
protect the environment and consumer interests, says a new report on
European standardisation, presented to EU internal market ministers by
Enterprise and Information Society Commissioner Erkki Liikanen on 27
September. The report notes that the European standards organisations CEN,
CENELEC and ETSI have made good progress, both in stepping up their output
of new standards and in cutting the costs of standardisation procedures, in
fields where harmonised standards offer a presumption of conformity with
requirements of single market directives. This makes it much easier to do
business on the single market. In addition to the promising results
achieved for construction product standards (the first harmonised ones for
cement became available this year), other products benefiting from this
system include toys, pleasure boats, pressure vessels, medical devices and
personal protective equipment.
