[01] Commission publishes draft new Chemicals Legislation for consultation
European Enterprise Commissioner Erkki Liikanen and Environment
Commissioner Margot Wallström have presented new proposals to overhaul and
modernise the EU's regulatory system for chemicals. Following discussion of
their approach, the Commission gave the go-ahead for an 8 weeks' Internet
consultation on the draft chemicals legislation. The aims of the proposed
new Regulation, which will replace 40 different pieces of current
legislation, are to increase the protection of human health and the
environment from exposure to chemicals while at the same time to maintain
and enhance the competitiveness and innovative capability of the EU
chemicals industry. In delivering both these aims, the proposals aims at
fully conforming to the balanced approach required by sustainable
development. Chemical substances are used in the manufacture of almost all
products we use every day at home or at work. The industry that produces
them plays a vital role in sustaining the competitiveness and innovative
potential of many final product manufacturers downstream. The system for
registering, evaluating and authorising chemical products should therefore
boost enterprise competitiveness and product innovation, to the long-run
benefit of chemicals manufacturers and importers, users, consumers and the
environment. The Internet consultation will enable interested parties to
comment on the detail of the future legal requirements before the proposal
is finalised by the Commission.
[02] Internal Market : Commission presents ten-point plan for making Europe
better off
The European Commission has published its Internal Market Strategy 2003-
2006, a ten-point plan to make the Internal Market work better, building on
the 2.5 million jobs and €877 billion of wealth it has already created
since Europe's frontiers were dismantled at the end of 1992. The Strategy
aims to respond to the challenges of enlargement and an ageing population
and to keep Europe on course to become the world's most competitive economy
by 2010. Particular priorities include improving the implementation and
enforcement of Internal Market law, making the free movement of services
into a practical reality, removing remaining obstacles to trade in goods
and building genuinely European public procurement markets. In a Union of
25, the onus will increasingly be on the Member States to make the Internal
Market work on a day to day basis. The Strategy calls on them to implement
Internal Market laws promptly and correctly, inform their citizens and
businesses of their rights, solve problems when they arise and refrain from
adopting national laws which conflict with Internal Market principles. The
Strategy proposes strengthening enforcement through closer cooperation
between the Commission and Member States, so that quick and effective
solutions can be obtained without systematic recourse to infringement
procedures.
[03] La Commission considère qu'il existe un déficit public excessif en
France
Dans un avis rendu en application de l'article 104, paragraphe 5, du traité,
la Commission européenne estime qu'il y a un déficit excessif en France.
Elle recommande au Conseil, en vertu du paragraphe 6 de ce même article,
d'adopter une décision en ce sens, et l'invite à adresser des
recommandations à la France conformément au paragraphe 7. Il est recommandé
au gouvernement français de mettre fin à la situation actuelle de déficit
excessif dès que possible et d'ici 2004 au plus tard. Les mesures
nécessaires doivent être prises avant le 3 octobre 2003. La Commission
s'acquitte ainsi des obligations que lui impose l'article 104 du traité, et
honore les engagements pris dans le cadre de la résolution du Conseil
européen sur le pacte de stabilité et de croissance en vue d'une
application rigoureuse, rapide et efficace de celui-ci.

[04] La Commission adopte une nouvelle définition des micro-entreprises
ainsi que des petites et des moyennes entreprises européennes
La Commission européenne a adopté une nouvelle définition des micro-
entreprises ainsi que des petites et des moyennes entreprises (PME) afin de
promouvoir l'entrepreneuriat, les investissements et la croissance, de
faciliter l'accès au capital risque, de réduire les charges administratives
et d'accroître la sécurité juridique. Cette nouvelle définition est le
fruit de deux séries de consultations publiques de grande ampleur. Elle
maintient les différents seuils d'effectifs qui déterminent les catégories
des micro-entreprises, des petites ou des moyennes entreprises, mais relève
considérablement les plafonds financiers (chiffre d'affaires ou total du
bilan), notamment en raison de la hausse de l'inflation et de la
productivité depuis 1996, date à laquelle remonte la première définition
communautaire des PME. Différentes dispositions ont pour effet de limiter
le bénéfice de l'accès aux mécanismes nationaux et aux programmes européens
de soutien aux PME aux seules entreprises qui possèdent les caractéristiques
des véritables PME (sans la force économique de groupements plus vastes).
Pour permettre une transition sans heurts aux niveaux communautaire et
national, la nouvelle définition entrera en vigueur le 1er janvier 2005.
Cette modernisation de la définition des PME aura un impact sur la
promotion de la croissance, de l'entrepreneuriat, des investissements et de
l'innovation. Elle favorisera la coopération et la création de grappes
d'entreprises indépendantes.
[05] Fight against terrorism : Security of European maritime transport to
be strengthened
Recent events have shown that no country in the world is immune from
terrorism, and shipping is no exception. Any ship can be deliberately used
as a weapon or be a carrier of weapons of mass destruction. The European
Commission considers that there is a need to enhance the security of the
entire maritime transport chain, from the supplier to the consumer.
Therefore it has adopted a Communication and a proposal for a regulation to
ensure the obligatory application throughout the EU of the highest security
standards on maritime transport, as agreed in the International Maritime
Organisation applicable to international commercial shipping, and to port
facilities serving them. But the new requirements proposed by the
Commission for a strengthened security will also apply to passenger ships
carrying out domestic voyages. Moreover, the provisions with regard to
security assessments, the drawing-up of security plans and the designation
of company and ship security officers will be extended to other ships used
for domestic traffic. The Regulation also foresees a process of inspections
supervised by the Commission to verify the harmonised implementation of
these new security rules throughout the EU.
[06] La Commission clôture son enquête sur Audiovisual Sport après la
fusion entre Sogecable et Vía Digital
La Commission européenne a décidé, après consultation des tiers intéressés,
de clore son enquête relative à l'acquisition par Audiovisual Sport (AVS)
des droits de retransmission des rencontres de la ligue espagnole de
football. Cette décision fait suite aux changements importants apportés par
Telefónica et Sogecable à leur accord d'entreprise commune ayant pour objet
l'acquisition et l'exploitation en commun des droits, qui ont eu pour effet
de donner accès à ces droits de retransmission à de nouveaux venus sur le
marché de la télévision numérique hertzienne et par câble et de leur
permettre de fixer librement leurs prix. La décision des autorités
espagnoles concernant la fusion des deux plates-formes de télévision à
péage dans le pays, à savoir Sogecable et Via Digital (Telefónica), a
également créé les conditions d'une concurrence accrue dans l'exploitation
des droits de retransmission des rencontres de football en Espagne. Il
convient aussi de noter qu'à l'issue de cette fusion, Sogecable a accepté
de racheter la part de Telefónica dans AVS, mettant ainsi fin à l'accord
qui avait été notifié à la Commission. Celle-ci continuera de suivre avec
attention le comportement des entreprises concernées ainsi que des sociétés
d'autres pays sur ces marchés des médias en rapide mutation.
[07] Commission recommends better cancer screening
Cancer kills about one in four people in Europe. The European Commission
calls on EU Member States to implement effective screening programmes for
breast cancer, colon cancer and cervical cancer. It has put forward a
proposal for a Council Recommendation on cancer screening that outlines
best practice guidelines in early detection of these cancers. Though Europe
has made good progress in reducing cancer deaths in recent years,
significant differences remain between countries. Health and Consumer
Protection Commissioner David Byrne stressed that many thousands of cancer
deaths could be avoided each year if best practice in early detection was
applied in all Member States.
[08] Troisième estimation pour le quatrième trimestre 2002 : le PIB de la
zone euro et de l'UE15 en hausse de 0,1% ; +1,2% et +1,4% respectivement
par rapport au quatrième trimestre 2001
Le Produit Intérieur Brut (PIB) de la zone euro et celui de l'UE15 ont
augmenté de 0,1% au cours du quatrième trimestre 2002, selon les
estimations publiées aujourd'hui par Eurostat. Ces résultats font suite à
une croissance de 0,3% dans la zone euro et de 0,4% dans l'UE15 au cours du
troisième trimestre 2002. En comparaison avec le quatrième trimestre 2001,
le PIB de la zone euro et celui de l'UE15 ont augmenté respectivement de 1,
2% et 1,4%, après des hausses de 1,0% et 1,2% au cours du trimestre
précédent.
[09] Commission staff study points that labour taxation has contributed to
European structural unemployment
A new study carried out by economists in the European Commission's
Directorate General of Economic and Financial Affairs analyses the effect
of labour taxes, including social security contributions, on Euro area
unemployment using an unobserved components model in order to control for
the presence of other structural determinants of unemployment. The paper
finds a significant impact of taxation on unemployment. According to the
estimates, a 1% point increase in labour taxes leads to an increase in
structural unemployment of about .3%. This study gives support to the view
that lowering labour taxes can help to reduce unemployment in continental

[10] Commission staff study points to economic and financial market
consequences of ageing populations
A new study carried out by economists in the European Commission's
Directorate General of Economic and Financial Affairs provides estimates of
the very significant economic and financial market effects of ageing
populations both at the EU and global levels. The study stresses that if
current policies do not change, and especially if labour market reforms are
not rapidly and systematically introduced, then the countries affected will
experience a very sharp downturn in the growth of their living standards
and in their underlying potential growth rates. To offset these effects the
paper urges governments : firstly to focus their policy efforts on tackling
the underlying growth problems of their economies through continuous
structural reforms ; secondly, to adopt a multi-faceted policy strategy
since there is no single best solution ; pension reforms are not a
substitute for labour market reforms which indeed have to proceed them ;
and thirdly, globalisation and engagement in emerging markets can provide
some relief for ageing developed economies, but a successful strategy
hinges on having a large "home-grown" component. Full document available on

[11] Marchés financiers : le groupe interinstitutionnel de surveillance des
marchés des valeurs mobilières publie son premier rapport
Le groupe interinstitutionnel de surveillance des marchés des valeurs
mobilières (ci-après "le groupe interinstitutionnel") a publié son premier
rapport sur "le processus Lamfalussy" (voir IP/02/195), qui vise à créer un
système de régulation plus efficace des marchés des valeurs mobilières en
Europe. Ce rapport fait suite au mandat donné au groupe interinstitutionnel
en 2002 par le Parlement européen, le Conseil des ministres des finances de
l'Union européenne et la Commission européenne (voir IP/02/1452). Ce groupe,
composé de six experts indépendants désignés à raison de deux par
institution, a été invité à évaluer l'avancement de la mise en œuvre du
processus Lamfalussy. Dans son rapport, il indique que, selon les éléments
fournis par les institutions et les acteurs du marché, des progrès
satisfaisants on été réalisés, mais que le processus, encore au stade de
"l'apprentissage par la pratique", reste améliorable.
[12] Commission infringement procedure against Italy for discriminatory
treatment of foreign language assistants at Italian universities
The European Commission has issued a reasoned opinion under Article 228 EC
for non-compliance by Italy with the judgment of the European Court of
Justice of 26 June 2001 in case C-212/99 concerning the allegedly
discriminatory treatment in relation to the recognition of the acquired
rights of the linguistic associates (former foreign-language assistants,
the so called "Lettori") at several Italian universities.
[13] Côte d'Ivoire : la Commission octroie une aide humanitaire d'environ 6
millions d'€
La Commission européenne a adopté un programme d'aide humanitaire de 5,74
millions d'euros afin de subvenir aux besoins élémentaires des groupes
vulnérables touchés par le conflit en Côte d'Ivoire. Les populations
déracinées et réfugiées dans les pays voisins bénéficieront également de
cette aide d'urgence. Les ressources financières, qui seront mises à
disposition par l'Office d'aide humanitaire de la Commission européenne,
ECHO, placé sous la responsabilité du commissaire Poul Nielson, permettront
de financer des programmes dans divers domaines (besoins alimentaires,
santé, nutrition, logistique, construction d'abris, installations
sanitaires/approvisionnement en eau). La mise en œuvre de ces mesures sera
confiée à des organisations humanitaires présentes dans la région.
[14] Pascal Lamy meets Candidate Countries ministers to enhance dialogue on
trade
European Trade Commissioner Pascal Lamy will meet the Trade Ministers from
the 13 Candidate Countries in Bucharest on 9 and 10 May to enhance dialogue
on trade and promote their co-operation on WTO issues. This meeting is the
last before the accession to the EU of ten of these countries. Ministers
will review progress made in ongoing WTO negotiations under the Doha
Development Agenda, in preparation for the forthcoming Ministerial Meeting
in September in Cancun, Mexico. Commissioner Lamy said : "We know that
speaking with one voice on trade matters makes us stronger in the world
trade scene. This meeting provides an excellent opportunity to send a
strong signal of our determination to a successful outcome of the Doha
Development Agenda."
