[01] Financial services : Commission acts to improve efficiency of EU
investment fund market
The European Commission has taken action in two specific areas to improve
the efficiency of the EU single market for retail investment funds. These
funds, known as 'UCITS', provide consumers with access to professionally
managed investments on affordable terms and now account for over €5500
billion of assets. First, the Commission has adopted legally binding
guidance on whether new financial instruments can be included in investment
funds. Second, it has issued guidance on how host country authorities
should exercise limited scrutiny powers when UCITS are notified for sale in
their country. These clarifications will ensure consistency in the
authorisation and marketing of investment funds across the EU. The
Commission will propose a more fundamental redesign of the EU 'passport'
for investment funds later in 2007.
[02] Participation de Louis Michel aux élections législatives belges
Le Président de la Commission européenne, José Manuel Barroso, a marqué
son accord à la demande de congé du Commissaire Louis Michel afin qu'il
puisse être candidat de son parti lors des prochaines élections
législatives en Belgique, qui se tiendront le 10 juin. Comme il l'avait
déjà avancé, M. Michel a tenu à informer officiellement le Président en
premier lieu dès qu'il a pris cette décision. M. Michel sera en congé
sans rémunération à partir du 12 mai, date de dépôt des
listes électorales, jusqu'au 10 juin 2007, date des élections. Il s'est
engagé à ne pas avoir recours aux services de la Commission ni à ses
ressources humaines et matérielles pendant cette période.
[03] Commission approves proposed acquisition of joint control of Capio AB
by Apax Partners Worldwide LLP, Apax Partners SA and Nordic Capital,
subject to conditions
The European Commission has approved under the EU Merger Regulation the
proposed acquisition of joint control of Capio AB, a Swedish provider of
healthcare services, by the private equity funds Apax Partners Worldwide
LLP ("APW") of the UK, Apax Partners SA ("APSA") of France and Nordic
Capital of the Channel Islands. The Commission's decision is conditional
upon the divestiture by Capio AB of most of its UK subsidiaries. In light
of these commitments, the Commission has concluded that the proposed
transaction would not significantly impede effective competition in the
European Economic Area or any substantial part of it.

le 16 mars, le régulateur italien, AGCOM, a informé la Commission qu'il
retirait son projet de mesure relatif au marché des services à valeur
ajoutée sur les réseaux mobiles (y compris les services de
renseignements). Dans sa lettre du 8 février 2007, la Commission avait
fait part à AGCOM de ses doutes quant à la définition de marché d'AGCOM
et à l'existence de problèmes de concurrence portant atteinte aux
intérêts des consommateurs ou requérant une réglementation ex-ante.
