  • [01] Equal treatment for all agency workers

    The European Commission today welcomed the decision by the European Parliament to approve the proposal for a directive on Temporary Agency Work. The European Parliament voted to support the Council's common position – adopted in June 2008 – without amendments so it can now become law. Over three million temporary agency workers currently working across the EU will benefit from better protection of their working conditions.

    [02] Aides d'État: la Commission approuve l'octroi par la France d'une aide à la R&D de €90 millions en faveur du programme de médicine personnalisée "ADNA"

    La Commission européenne a approuvé, en application des règles du traité CE sur les aides d'État, une aide d'un montant de 90 millions d'euros que la France prévoit d'octroyer en faveur du programme de R&D «ADNA», concernant le développement de la médecine personnalisée dans le domaine des maladies infectieuses, des cancers et des maladies génétiques. L'aide proposée devrait avoir des retombées positives importantes en termes de diffusion des connaissances et d'amélioration de la santé, tout en ayant une incidence limitée sur la concurrence. En effet, en raison des risques élevés, ce genre de programme n'est pas suscité spontanément par le marché, une grande partie des résultats sera mise à la disposition de tout intéressé et la plupart des bénéficiaires ne détient que de faibles parts des marchés pertinents. La Commission a dès lors conclu que l'aide était compatible avec l'encadrement de l'UE sur les aides à la recherche, au développement et à l'innovation (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/06/1600&format=HTML&aged=1&language=EN&guiLanguage=en">IP/06/1600 and <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/06/441&format=HTML&aged=1&language=EN&guiLanguage=en">MEMO/06/441).

    [03] Aides d'État: la Commission demande à la Hongrie de mettre fin à l’indemnisation en faveur de Erste Bank, l’acheteur de Postabank

    La Commission européenne a demandé à la Hongrie, en vertu des règles communautaires sur les aides d'État, de mettre fin à l’indemnisation au titre de créances inconnues qu’elle a fournie à l’acheteur, Erste Bank, lors de la privatisation de Postabank. Au terme d’une enquête approfondie ouverte en octobre 2004 (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/04/1258&format=HTML&aged=1&language=FR&guiLanguage=en">IP/04/1258), la Commission est parvenue à la conclusion que la mesure était contraire aux règles en matière d’aides d’État car un investisseur privé agissant avec prudence n’aurait pas accordé d’indemnisation illimitée à l’acquéreur de Postabank. Bien que l’indemnisation au titre de créances inconnues ait été accordée avant l'adhésion de la Hongrie à l'UE, la Commission est compétente pour l’examiner car le risque financier précis auquel s’exposait l’État hongrois n’était pas suffisamment défini à la date de l’adhésion (1er mai 2004). La Commission estime toutefois que les courriers envoyés à la Hongrie par ses services à cette époque manquaient de clarté quant à l'obligation de préciser le risque potentiel. Erste Bank n'a donc pas à rembourser l'aide qui lui a été versée.

    [04] State aid: Commission endorses remuneration for distribution of postal bonds by "Poste Italiane"

    The European Commission has decided under EC Treaty state aid rules that the remuneration paid by the state-controlled financial body 'Cassa Depositi e Prestiti' to 'Poste Italiane', the Italian universal postal service provider, for the distribution of postal bonds from 2000 to 2006 does not constitute state aid. The Commission's in-depth investigation, opened in November 2006 (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/06/1605&format=HTML&aged=1&language=EN&guiLanguage=en">IP/06/1605), found that the remuneration was consistent with market conditions and therefore did not unduly favour ‘Poste Italiane’ over its competitors.

    [05] State aid: Commission approves €35 million Spanish aid to ITP for development of Trent 1000 aircraft engine

    The European Commission has authorised, under the EC Treaty rules on state aid (Article 88(2)), €35 million of public funding that Spain intends to give to Industria de Turbo Propulsores (ITP) for the development of the low- pressure turbine for the Trent 1000 engine. The latter is being developed by Rolls-Royce for the Boeing B787. After an in-depth investigation, launched in March 2007 (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/07/395&format=HTML&aged=1&language=EN&guiLanguage=en">IP/07/395), the Commission found that the project satisfied the requirements of the EU framework for state aid for research, development and innovation. In particular, the project incites ITP to carry out additional research, the public funding will be reimbursed according to the success of the project and the relevant provisions on eligible costs and aid intensity have been respected. The Commission therefore concluded that the aid does not threaten to distort competition in the Single Market.

    [06] Ententes: La Commission ouvre des consultations en vue du réexamen de l'exemption par catégorie dont bénéficient les consortiums assurant des services de transports maritimes

    La Commission européenne a ouvert des consultations concernant un projet de règlement portant révision de l'exemption de l'interdiction des pratiques commerciales restrictives prévues par l'article 81 du traité CE, exemption dont bénéficient actuellement les consortiums maritimes. Le règlement 823/2000 concernant l'exemption par catégorie en faveur des consortiums autorise les compagnies maritimes de ligne à conclure des accords de coopération en vue de la fourniture de services en commun (consortiums). Le nouveau projet de règlement propose de maintenir l'autorisation de ces accords de coopération dans le cadre d'un nouvel environnement législatif et économique. Les parties intéressées sont invitées à faire part de leurs observations dans le cadre de la consultation publique avant le 21 novembre 2008. La Commission consultera ensuite les États membres 2009 avant d'adopter en temps utile, c'est à dire avant l'expiration en avril 2010 du règlement actuel, le règlement final sur l'exemption par catégorie.

    [07] Concentrations: la Commission révise la communication sur les mesures correctives et modifie le règlement d'application du règlement sur les concentrations

    La Commission européenne a révisé ses orientations relatives aux mesures correctives en matière de contrôle des concentrations afin de faire en sorte que les problèmes de concurrence soient traités de manière plus efficace et de proposer une information plus claire aux entreprises parties à une concentration quant à la meilleure façon de répondre aux préoccupations qu'elle a exprimées. Les mesures correctives sont les modifications apportées à une opération notifiée par les parties en cause en vue d'éliminer les problèmes de concurrence qu'elle aurait recensés. Les principaux changements ont consisté à prévoir un formulaire permettant de fournir des renseignements sur les mesures correctives, à préciser les mesures correctives en matière d'accès et de cession, et à clarifier le rôle de l'administrateur. La Commission a également modernisé la communication sur les mesures correctives à la lumière du règlement (CE) n° 139/2004 révisé sur les concentrations (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/04/9&format=HTML&aged=1&language=FR&guiLanguage=en">MEMO/04/9), de l'expérience acquise dans le cadre de nombreuses affaires, de l'étude des mesures correctives appliquées dans les affaires de concentration (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/05/1327&format=HTML&aged=1&language=FR&guiLanguage=en">IP/05/1327) et d'arrêts récents des juridictions communautaires. La communication sur les mesures correctives tient également compte des commentaires exprimés au cours de la consultation publique qui s'est tenue en 2007 sur le projet de communication (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/07/544&format=HTML&aged=1&language=FR&guiLanguage=en">IP/07/544). Par ailleurs, la Commission a adapté le règlement sur les concentrations (règlement (CE) n° 802/2004 de la Commission) en fonction des modifications apportées à la communication sur les mesures correctives.

    [08] EU institutions agree to communicate in partnership

    Today in the European Parliament a political declaration was signed which aims at encouraging cooperation among the EU institutions and member states on communication about Europe. The declaration, entitled "Communicating Europe in Partnership", was signed by Alejo Vidal-Quadras, Vice-President of the European Parliament, the French Minister of State Jean-Pierre Jouyet, on behalf of the Council of the EU and Margot Wallström, Vice-President of the European Commission.

    [09] Une nouvelle étape pour la stratégie européenne en faveur des régions ultrapériphériques

    Danuta Hübner, Commissaire chargée de la politique régionale, présente aujourd'hui la communication "Les régions ultrapériphériques: un atout pour l'Europe", qui propose une stratégie renouvelée vis-à -vis des sept régions : les quatre départements français d'Outre-mer, la Guadeloupe, la Guyane, la Réunion et la Martinique, les régions autonomes portugaises des Açores et de Madère et la Communauté autonome espagnole des Îles Canaries. La Commissaire appelle à considérer les régions ultrapériphériques (RUP) en tant que "régions-opportunité", porteuses de potentiels de développement pour l'ensemble de l'Union. Ce changement d'approche pourra être mis en œuvre à travers une utilisation optimale de tous les instruments communautaires existants, l'approfondissement des connaissances sur les RUP et le renforcement du partenariat.

    [10] Feu vert pour des véhicules «propres» et économes en énergie

    La Commission européenne se félicite de l’appui donné aujourd’hui par le Parlement européen à sa proposition visant à encourager, par des procédures de marchés publics, la commercialisation à grande échelle de véhicules propres et économes en énergie. L’objectif est de réduire la consommation de carburant des véhicules routiers ainsi que leurs émissions de CO2 et de polluants. Le vote du Parlement européen repose sur un accord conclu avec les États membres, qui devraient adopter prochainement la proposition.

    [11] Commission welcomes European Parliament’s strong support for a new Safer Internet Programme

    The European Parliament cast an overwhelmingly positive vote today on the report drafted by MEP Roberta Angelilli which supports the launch of a new EU Safer Internet programme. The 5-year programme (2009–13), proposed by the European Commission last February, will have a budget of € 55 million to combat illegal online content but also to tackle illegal and harmful conduct such as grooming and cyberbullying.

    [12] EU27 current account deficit € 30.9 billion

    According to the latest revisions, the EU27 external current account recorded a deficit of € 30.9 billion in the second quarter of 2008, compared with a deficit of € 10.2 billion in the second quarter of 2007 and a deficit of € 20.1 billion in the first quarter of 2008. In the second quarter of 2008, compared with the second quarter of 2007, the deficit of the goods account increased significantly (€ -49.0 billion compared with € -28.3 billion), while the surplus of the services account diminished (€ +20.5 billion compared with € +24.5 billion). The surplus of the income account rose (€ +9.7 billion compared with € +5.5 billion). The deficit of the current transfers account slightly increased (€ -12.1 billion compared with € -11.8 billion). The surplus recorded in the services account (€ +20.5 billion euro) is mainly the result of surpluses in "other business services", which includes miscellaneous business, professional and technical services (€ +8.1 billion), financial services (€ +7.4 billion), transportation (€ +4.7 billion) and computer & information services (€ +4.6 billion), partially offset by deficits in travel (€ -5.0 billion) and royalties & license fees (€ -1.6 billion).These provisional data, issued by Eurostat are subject to revision.

    [13] Déficit public de la zone euro et de l’UE27 respectivement de 0,6% et 0,9% du PIB

    Le déficit public s’est réduit en valeur absolue, en 2007 par rapport à 2006, tant dans la zone euro (ZE15) que dans l’UE27, tandis que la dette publique a augmenté. Dans la zone euro, le déficit public a baissé de 1, 3% du PIB en 2006 à 0,6% en 2007, et dans l’UE27 de 1,4% à 0,9%. Le ratio de la dette publique par rapport au PIB a diminué dans la zone euro, de 68, 5% à la fin de 2006 à 66,3% à la fin de 2007, ainsi que dans l’UE27, de 61,3% à 58,7%. Dans le présent communiqué de presse, Eurostat fournit les données relatives au déficit et à la dette des administrations publiques, basées sur les chiffres déclarés par les États membres dans le cadre de la deuxième notification de 2008 pour les années 2004 à 2007 en vue de l’application de la procédure concernant les déficits excessifs.

    [14] Commission clears acquisition of MIBV, MMZ and Promet by SCM and Energees

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of Metinvest BV (MIBV) of The Netherlands and its subsidiaries Makeeva Metallurgical Plant (MMZ) of the Ukraine and Promet Steel JSC (Promet) of Bulgaria by System Capital Management Limited (SCM) of Cyprus and Energees Investments Limited (Energees) of Cyprus. SCM produces metals and coal. Energees produces steel. MIBV is active in iron ore and coal mining, semi-finished and finished steel production. MMZ produces and sells raw steel materials and manufactures downstream products in the steel sector. Promet produces downstream products in the steel sector. The operation was examined under the simplified merger review procedure.

    [15] Commission clears joint venture between PTT Chemical and Sime Darby

    The European Commission has granted clearance under the EU Merger Regulation to the joint venture between PTT Chemical Public Company Limited of Thailand and Sime Darby Plantation BHD, a subsidiary of Sime Darby Berhad plc of Malaysia. PTT Chemical manufactures coke and refined petroleum products and other chemical products. Sime Darby Plantation BHD manufactures chemical products and is active in real estate. The joint venture will manufacture organic chemicals. The operation was examined under the simplified merger review procedure.

    [16] Speeding up innovation to boost competitiveness: Europe INNOVA Conference 2008

    Accelerating innovation in Europe, optimising knowledge transfer, strengthening industry's innovation capacity through strategic partnerships and supporting innovative entrepreneurs: these topics rank high on the agenda of the second Europe INNOVA Conference, which started today in Lyon (up to 24 October). The Europe INNOVA Conference is organised by the European Commission in collaboration with the French Presidency of the EU and the Lyon regional authority. The risk of an economic slowdown in the aftermath of the financial crisis makes it even more important to further boost EU competitiveness by betting on knowledge and excellence. Recognising the key role of innovation in this context, the conference will examine the necessary tools and policies to build the economic environments, which nurture innovation in enterprises.     [17] Concentrations: la Commission donne le feu vert au projet d’acquisition de Jet Scandinavia par StatoilHydro sous réserve du respect de certaines conditions

    La Commission européenne a autorisé, en vertu du règlement sur les concentrations de l'UE, le projet de rachat par la compagnie norvégienne StatoilHydro du réseau de stations-service «Jet» en Scandinavie, actuellement détenu par ConocoPhillips, à l'issue d'une enquête approfondie ouverte en mai 2008 (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/08/740&format=HTML&aged=0&language=FR&guiLanguage=en">IP/08/740). Pour obtenir cette autorisation, StatoilHydro s’est engagée à céder les 40 stations-service «Jet» qu'elle détient en Norvège et un réseau de 158 stations-service en Suède exploitées sous les marques «Jet», «Hydro» et «Uno-X». Vu cet engagement, la Commission a conclu que l’opération envisagée n'entraînerait pas de problème de concurrence dans l’Espace économique européen (EEE) ou une partie substantielle de celui-ci.

    [18] State aid: Commission approves restructuring of German bank IKB

    The European Commission has approved, under EC Treaty state aid rules, a €9 billion restructuring package, for German bank IKB. After financial difficulties arising from the US-subprime crisis in July 2007, IKB was granted two risk shields, capital injections and liquidity facilities. In the context of the restructuring, the bank was sold to the US investment fund Lone Star in August 2008. Following an in-depth investigation, launched in February 2008 (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/08/314&format=HTML&aged=1&language=EN&guiLanguage=en">IP/08/314 and <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/08/124&format=HTML&aged=1&language=EN&guiLanguage=en">MEMO/08/124), the Commission has concluded that the measures were compatible with EU rules on state aid to companies in difficulties (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/04/172&format=HTML&aged=1&language=EN&guiLanguage=en">MEMO/04/172). The package will allow for the restructuring of the bank, while the significant scaling back of IKB's activities will limit the distortion of competition created by the state support.

    [19] Aides d'État: la Commission autorise une aide à la restructuration de 31 millions € destinée au fabricant français d'électroménager FagorBrandt

    La Commission européenne a, en application des règles du traité CE relatives aux aides d'État, autorisé l'aide à la restructuration d'un montant de 31 millions € que la France a l'intention d'accorder au fabricant d'appareils électroménagers FagorBrandt. À l'issue d'une enquête approfondie, initiée en octobre 2007 (voir <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/07/1483&format=HTML&aged=1&language=FR&guiLanguage=en">IP/07/1483), la Commission a conclu que le plan de restructuration présenté par les autorités françaises permettait de restaurer la viabilité de l'entreprise à long terme et que l'aide en question se limitait au minimum nécessaire pour mener à bien cette restructuration. Ce feu vert est assorti de conditions visant à éviter des distorsions de concurrence indues. La France doit recouvrer les aides illégales reçues par FagorBrandt en 2002 avant d'octroyer l'aide à la restructuration qui vient d'être autorisée. Au vu de ces conditions, la Commission considère que l'aide est compatible avec les lignes directrices communautaires pour les aides d'État au sauvetage et à la restructuration des entreprises en difficulté.

    [20] State aid: Commission endorses municipality of Rotterdam's €42 million investment in the Ahoy complex

    The European Commission has approved under EC Treaty state aid rules a €42 million investment by the municipality of Rotterdam in the renovation and development of the Sports Palace, forming part of the Ahoy complex. After an in-depth investigation, launched in January 2008 (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/08/111&format=HTML&aged=1&language=EN&guiLanguage=en">IP/08/111), the Commission has found that the investment did not give undue advantages to the operator of the complex or any other company as the investment was properly taken into account in the sale and lease transactions concluded between the municipality and the operator. Therefore, the Commission has concluded that no state aid is involved.

    [21] The Commission welcomes the adoption of Erasmus Mundus II by the European Parliament

    The European Commission welcomes today's vote in the European Parliament in favour of establishing the second phase of Erasmus Mundus (2009-2013) programme. The European Union will thus continue to support joint programmes in Europe with grants to the most highly-talented students and professors from third countries, but will also extend the scope of the programme to the doctoral level and give more financial support to European students.
