    [01] Commission adopts proposal to regulate credit rating agencies (see MEMO/08/691)

    The European Commission has put forward a proposal for a Regulation on credit rating agencies. This proposal is part of a package of proposals to deal with the financial crisis and adds to Commission's proposals on Solvency II, Capital Requirements Directive, Deposit Guarantee Schemes and accounting. The new rules are designed to ensure high quality credit ratings which are not tainted by the conflicts of interest which are inherent to the ratings business.

    [02] Antitrust: Commission fines car glass producers over €1.3 billion for market sharing cartel

    The European Commission has imposed fines, totalling €1 383 896 000 on Asahi, Pilkington, Saint-Gobain and Soliver for illegal market sharing, and exchange of commercially sensitive information regarding deliveries of car glass in the EEA, in violation of the EC Treaty’s and the EEA Agreement’s ban on cartels and restrictive business practices (Article 81 of the EC Treaty and Article 53 of the EEA Agreement). Asahi, Pilkington and Saint-Gobain are the three major players in Europe. Between early 1998 and early 2003 these companies discussed target prices, market sharing and customer allocation in a series of meetings and other illicit contacts. The Belgian company Soliver also took part in some of these discussions. These four companies controlled about 90% of the glass used in the EEA in new cars and for original branded replacement glass for cars at that time, a market worth about €2 billion in the last full year of the infringement. The Commission started the cartel investigation on its own initiative following a tip-off from an anonymous source. The Commission increased the fines on St Gobain by 60% because it was a repeat offender. Asahi provided additional information to help expose the infringement and its fine was reduced by 50% under the Leniency Notice. These are the highest cartel fines Commission has ever imposed, both for an individual company (€896 000 000 on Saint Gobain) and for a cartel as a whole.

    [03] Aides d'Etat: la Commission conclut que La Banque Postale n'a pas reçu d'aide de la réforme du financement des retraites des fonctionnaires de La Poste française

    La Commission européenne a décidé, en vertu des règles du traité CE sur les aides d'Etat, que La Banque Postale n'a pas tiré d'avantage de la répartition entre La Poste et elle-même de la charge représentée par les deux milliards d'euros que La Poste a versés en 2006 à l'établissement public national de financement des retraites. La Banque Postale n'a donc pas bénéficié d'une aide d'Etat. La Commission s'est en particulier assuré que le calcul de la contribution de La Banque Postale tenait compte de la part des personnels multi-métiers travaillant effectivement pour cette dernière.

    [04] EU-Libya: negotiations on future Framework Agreement start

    Libya and the EU start tomorrow in Brussels the negotiations on the EU- Libya Framework Agreement. European Commissioner for External Relations and European Neighbourhood Policy, Benita Ferrero-Waldner, joint by EU Presidency, will formally launch the negotiations in a meeting with the Libyan representatives led by Abdulati Elobeidi, Secretary for European Affairs, and Mohamed Tahar Siala, Deputy Secretary at the General People Committee for Foreign Liaison and International Cooperation of Libya. The future agreement will establish the framework of the relations between the EU and Libya.

    [05] State aid: Commission extends scope of in-depth inquiry into proposed restructuring aid to PZL Hydral of Poland

    The European Commission has extended the scope of an in-depth investigation launched under EC Treaty state aid rules in September 2008 (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=IP/08/1308&format=HTML&aged=0&language=EN&guiLanguage=en">IP/08/1308) to establish whether aid, which Poland intends to grant for the restructuring of PZL Hydral, is in line with the EU Guidelines on state aid for rescuing and restructuring firms in difficulty (see <a href="http://europa.eu/rapid/pressReleasesAction.do?reference=MEMO/04/172&format=HTML&aged=1&language=EN&guiLanguage=en">MEMO/04/172). In the course of the investigation, it became apparent that more measures than initially identified needed to be investigated. The additional measures increase the amount of state aid from €37.5 million (PLN 130.5 million) to € 46.5 million (PLN 158.1 million). The opening of an in- depth investigation allows interested parties to comment on the proposed measures. It does not prejudge the outcome of the procedure.

    [06] Commission approves Polish aid for multimodal transport

    The European Commission authorised today a Polish aid scheme which intends to encourage the development of multimodal transport through the construction of logistics centres and terminals.

    [07] Alitalia: la Commission adopte deux décisions en matière d’aides d’État

    La Commission européenne a conclu aujourd’hui que la vente des actifs d'Alitalia ne constitue pas une aide d’État à condition que les engagements donnés par les autorités italiennes soient pleinement respectés. Cette vente est prévue dans le cadre de la procédure d'administration extraordinaire qui doit aboutir à la liquidation de la compagnie aérienne italienne. L'Italie a donc reçu le feu vert de la Commission pour procéder à la vente des actifs, Cette décision fait suite à une autre décision de la Commission clôturant la procédure officielle d’examen en matière d’aides d’État qu’elle avait ouverte le 11 juin 2008 à propos d'un prêt de €300 millions octroyé par l'Italie à Alitalia. La Commission conclut que ce prêt constitue une aide illégale et incompatible avec le marché commun.

    [08] Transport aérien: la Commission autorise l'aide au sauvetage en faveur de la compagnie Alpi Eagles

    Aujourd'hui, la Commission européenne a autorisé une aide au sauvetage en faveur d’un transporteur régional basé dans la région italienne de Vénétie, la société Alpi Eagles SpA. Cette aide consiste en une garantie d'emprunt de 17 millions d’euros sur les six prochains mois afin de permettre à la compagnie aérienne de reprendre ses vols.

    [09] Mergers: Commission clears proposed acquisition of Applied Biosystems by Invitrogen

    The European Commission has approved under the EU Merger Regulation the proposed acquisition of Applied Biosystems by Invitrogen, both of the US. The Commission concluded that the transaction would not significantly impede effective competition within the European Economic Area (EEA) or a substantial part of it.

    [10] Vice-President Tajani presents road safety awards

    Antonio Tajani, Vice-President of the European Commission responsible for transport, will today present the European Road Safety Charter’s Excellence in Road Safety Awards. These Awards will go to the six organisations that have made the most impressive commitments to improving road safety. During the ceremony, 16 new partners will sign up to the Charter, most of them large European companies whose commitments under the Charter will have a major impact on road safety.

    Bien que la libre circulation des marchandises au sein de l’UE soit garantie, les entreprises peuvent rencontrer des difficultés pour vendre leurs produits dans d’autres États membres à cause des réglementations nationales qui y sont en vigueur. Il existe cependant un outil très efficace qui permet d’anticiper les entraves inutiles aux échanges et de les empêcher. Il s’agit de la procédure de notification instituée par la directive 98/34/CE et par la directive 83/189/CE qui l’a précédée. Depuis 25 ans, tout État membre qui envisage d’adopter une nouvelle réglementation technique portant sur des produits ou des services de la société de l’information est tenu, avant l’adoption de son projet au niveau national, d’en informer la Commission et les autres États membres qui ont ainsi la possibilité de l’examiner pendant une période dite de «statu quo». Les entreprises également ont la possibilité de contribuer activement à la lutte contre les charges administratives inutiles en ayant recours à cette procédure de notification. Depuis 1984, plus de 12 000 projets de réglementation ont ainsi été traités.

    [12] Le concombre courbe fait son retour sur les étals: la Commission va autoriser la vente des fruits et légumes hors normes

    Les normes relatives à la taille et à la forme des fruits et légumes appartiennent désormais au passé après que les États membres de l'Union européenne ont approuvé aujourd'hui les propositions de la Commission visant à abroger les normes de commercialisation applicables à 26 types de fruits et légumes. L'initiative de la Commission visant à éliminer lesdites normes constitue un élément majeur dans ses efforts de rationalisation et de simplification des règles de l'UE ainsi que de réduction des lourdeurs administratives. Pour dix types de fruits et légumes, notamment pour les pommes, les fraises et les tomates, les normes de commercialisation seront maintenues. Mais même pour ces dix derniers, les États membres pourront autoriser la vente au détail des spécimens ne correspondant pas aux normes, pour autant qu'ils soient étiquetés de manière à les distinguer des produits relevant des catégories «Extra», «I» et «II». En d'autres termes, en vertu des nouvelles règles, les autorités nationales seront autorisées à permettre la vente au détail de tous les fruits et légumes, indépendamment de leur taille et de leur forme.

    [13] European Commission and Government of India sign Joint Declaration on policy dialogue in education

    On his first official visit to India, the European Commissioner for Education, Training, Culture and Youth, Ján Figel' today signed a Joint Declaration with his ministerial counterpart in the field of education. With this Declaration the European Commission and the Government of India aim to reinforce their cooperation in the form of a policy dialogue on key issues in education.

    [14] Industrial production down by 1.6% in euro area

    In September 2008 compared with August 2008, seasonally adjusted industrial production fell by 1.6% in the euro area (EA15) and by 1.1% in the EU27. In August production grew by 0.8% and 0.3% respectively. In September 2008 compared with September 2007, industrial production decreased by 2.4% in the euro area and by 2.1% in the EU27. These estimates are released by Eurostat.
