[01] Lutte antifraude : une importante mesure communautaire entre en
vigueur
La "convention relative à la protection des intérêts financiers des
Communautés européennes", que les Etats membres avaient signée dès le 26
juillet 1995 dans le cadre du troisième pilier, est enfin entré en vigueur
hier. En vertu de cette convention, la fraude, la corruption active et la
corruption passive portant atteinte aux intérêts financiers de l'UE sont à
présent définies de manière uniforme comme infractions pénales dans tous
les codes pénaux des Etats membres. La Commission européenne estime que
l'article 280 du traité CE confère à l'UE le pouvoir de prévoir dans le
droit communautaire des mesures pénales de cette nature, et elle avait
présenté, le 23 mai 2001, une proposition de directive en ce sens. Celle-ci
a reçu, dans l'intervalle, l'approbation du Parlement européen et de la
Cour des comptes des Communautés européennes, mais les négociations sont
dans l'impasse au Conseil. C'est pourquoi le commissaire responsable du
budget, Mme Michaele Schreyer, se réjouit malgré tout qu'une première étape
ait été franchie, au moins dans la ratification par les Etats membres des
instruments relevant du troisième pilier : "Plus de sept ans après la
signature de la convention, son entrée en vigueur est possible depuis que
la Belgique, l'Irlande et l'Italie ont, en derniers, ratifié le texte cette
année. Les Etats membres doivent enfin traiter les fraudes au budget
communautaire comme des 'infractions pénales, selon des critères uniformes.
Il s'agit, dans la lutte contre la fraude, d'une avancée commune importante
qui devra cependant aussi se traduire dans les faits dans la répression des
infractions", a-t-elle déclaré.
[02] Commission clears JV between RWE Solutions and Schott Glaskontor
The European Commission has granted clearance under the Merger Regulation
the creation of a joint venture RWE Schott Solar between RWE AG and Schott
Glaskontor GmbH, which belongs to Carl Zeiss group. The joint venture which
will produce solar panels (the operation, notified on 16/09 was examined
under the simplified merger review procedure).
[03] EU research looks into Europe's carbon sinks
Are European forests, soil and grass part of the solution for dealing with
carbon dioxide (CO²) emissions ? Today the European Commission presented
the CarboEurope research initiative in Valencia (Spain). It is a cluster of
15 research projects supported by the European Commission with a budget of
€25 million. The project brings together around 160 research institutions
from over 20 countries. It looks at whether the biosphere, and above all
forests, can reduce the concentration of carbon dioxide in the atmosphere,
the principal cause of climate warming. The Earth's biosphere can absorb
more carbon than it releases. European forests could therefore be huge
carbon sinks. CarboEurope's preliminary results point to a CO² absorption
rate of up to 30% of EU annual industrial emissions.
[04] La Commission approuve une enveloppe de 132 millions d'€ pour lutter
contre les maladies animales
La Commission européenne a approuvé une aide financière pour lutter contre
les encéphalopathies spongiformes transmissibles (EST) et d'autres maladies
animales dans l'UE en 2003. Le budget communautaire contribuera à raison de
94 millions d'€ au financement de la surveillance de l'ESB et de la
tremblante. La Commission a également adopté des dispositions de
financement pour les programmes 2003 d'éradication des maladies animales et
de prévention des zoonoses telles que la salmonellose. L'UE consacrera 38
millions provenant de ses ressources dans le domaine vétérinaire à
l'éradication et la surveillance de maladies animales importantes dans les
Etats membres. Les maladies ciblées par ces programmes ont des effets à la
fois sur la santé humaine et sur la santé animale, ou provoquent de graves
pertes dans les élevages de bétail et constituent donc des entraves aux
échanges intra-communautaires ou internationaux.
[05] Commission seeks information from Luxembourg concerning its compliance
with Court ruling on water pollution by nitrates
The European Commission is to formally request information concerning
Luxembourg's compliance with measures designed to combat water pollution by
nitrates. This follows a judgement made by the European Court of Justice in
March 2001 which, in accordance with the Nitrates Directive, called for
tougher measures to be adopted by Luxembourg. Within the EU, Luxembourg is
one of the four Member States with the highest livestock density, and the
highest surplus of nitrogen per hectare of cultivated soil. The Directive
aims to control the use of nitrate fertilisers and the disposal of animal
wastes, thereby avoiding high nitrate levels in drinking water, and
restricting harmful plant and plankton growth in threatened water bodies
such as small rivers, the Maas, the Rhine and the nutrient-enriched North
Sea. Although slightly improved in November 2001, Luxembourg's action
programme on nitrate use does not ensure that sufficient precautions are
taken in a number of key areas; the farming of unfertilised strips along
watercourses, restricted nutrient spreading on slopes and areas covered by
snow and the balanced fertilisation of crops. The request for information
to Luxembourg takes the form of a "Letter of Formal Notice", sent in
accordance with Article 228 of the EC Treaty.
[06] En visite au Portugal, Loyola de Palacio appelle à mettre fin aux
barrières du marché européen de l'énergie
Au cours de son voyage officiel au Portugal, du 16 au 18 octobre, Loyola de
Palacio, vice-présidente de la Commission européenne en charge des
transports et de l'énergie, a pu aborder les principaux thèmes liés à son
portefeuille, notamment la réalisation du marché unique de l'énergie. A
cette occasion, elle a rappelé que subsistaient de nombreuses barrières à
la réalisation d'un véritable marché de l'énergie, encore marqué par
d'importantes asymétries et des disparités en termes de tarifs d'accès et
d'infrastructures. Elle a plaidé en faveur d'une accélération de
l'ouverture du marché, condition d'une plus grande compétitivité
européenne. Néanmoins, a-t-elle ajouté, "cette ouverture ne peut jamais se
faire au détriment des petits consommateurs, ni mettre en danger la
sécurité d'approvisionnement : la Commission y veillera tout
particulièrement".
[07] Commission welcomes agreement on Directive to prevent major accident
hazards
European Environment Commissioner Margot Wallström welcomed the political
agreement reached on the revision of the Seveso II Directive at the
Environment Council yesterday. "I am pleased that the Council today
unanimously decided to strengthen the provisions of the existing Seveso II
directive. This agreement means that more industrial sectors will be
covered under the Directive and it further restricts the use and handling
of dangerous substances. It will therefore help to prevent major accidents
involving dangerous substances like the ones at Baia Mare, Enschede and
Toulouse from happening again".
[08] New GMO Directive provides more transparent and effective system for
authorisation of GMOs, says Commission
European Environment Commissioner Margot Wallström welcomed yesterday the
application of Directive 2001/18/EC on the deliberate release into the
environment of genetically modified organisms, from 17 October. This
Directive replaces a previous Directive (90/220/EEC), which has been in
force for the past ten years. Ms Wallström said : "The European public is
aware that the application of new biotechnologies in the sectors of food,
health and environment is an increasingly important reality. My top
priority is to protect human health and the environment. Therefore, it is
our responsibility as policy makers to take strong political leadership to
ensure that these technologies are appropriately regulated. With the new
Directive which is operational from today we have a strong basis for a
transparent and responsible way of governing the use of GMOs."
[09] Humanitarian crisis in Southern Africa : the EU's response rises to
€310 million
In response to the continuing humanitarian crisis in Southern Africa, the
European Union today announced that its contribution has risen to €310
million. This amount is destined primarily to the hardest hit countries in
the region : Zimbabwe, Malawi and Zambia. This announcement was made at a
European Commission regional seminar held over the last three days (15-17
October) in Pretoria where more than 40 representatives from EU
Headquarters in Brussels and Commission Delegations in Africa met in order
to discuss and improve the EU's response to the current crisis. In-depth
discussions covered the various technical, political and management aspects
of the crisis. Food and humanitarian aid has already been delivered to
countries in the region via partners such as the World Food Programme, Non-
Governmental Organisations (NGOs) and beneficiary governments.
[10] Anna Diamantopoulou to take live web questions on Muslim women in
Europe
Anna Diamantopoulou, European Commissioner for Employment and Social
Affairs, is set to appear live on the web in an internet conference on
Thursday 24 October 2002 to discuss "Muslim women in the European Union".
The conference is part of the EU's efforts to combat discrimination and
promote equality, and follows recent visits by the Commissioner to the
Palestinian Territories and Israel. On the day of the conference, lines
will be open from 16.00 to 18.00 CET.

plus dans le développement rural"
"Plutôt que d'accompagner la politique agricole commune (PAC), les mesures
agroenvironnementales devront devenir demain une pièce maîtresse de celle-
ci", lit-on dans une étude indépendante publiée aujourd'hui, intitulée
"L'intégration de l'environnement dans la PAC". Indiquant que "l'une des
exigences prioritaires serait d'accroître substantiellement le budget
consacré au deuxième pilier (développement rural)" et qu'"il serait
judicieux, du point de vue environnemental, de continuer à progresser dans
la voie du découplage [des aides par rapport à la production]", l'étude
souligne l'importance de la réforme de la PAC et appuie énergiquement les
orientations définies dans les propositions de la Commission pour la
révision à mi-parcours. Réalisée par l'Institute for European Environmental
Policy de Londres, organisme indépendant renommé pour sa compétence en
matière de problèmes liés à l'environnement, cette étude commandée par la
direction générale de l'agriculture avait été entreprise en novembre 2000.
Elle constitue la récapitulation la plus complète dont on dispose pour
alimenter l'actuel débat sur l'intégration de l'environnement dans la
politique agricole commune.
