  • [01] Landmark agreement on reforms of EU pharmaceutical legislation

    Agreement has been reached, following the second reading in the European Parliament yesterday, on far-reaching reforms to the EU's regulatory framework for pharmaceuticals. These reforms guarantee a high level of health protection for European citizens. They also strengthen the internal market for pharmaceutical products, reinforce the competitiveness of Europe's pharmaceutical industry and help meet the twin challenges of enlargement and globalisation. The new rules will improve and speed up access to new and innovative pharmaceutical products, building on the proven success of the European Medicines Evaluation Agency (EMEA) set up in 1995. Changes include a new fast-track authorisation procedure, the possibility of conditional authorisation for products and a harmonised period during which test and other data is protected in order to reward innovation. The generic pharmaceutical industry also benefits through clearer rules and procedures and the possibility for them to start testing their products in advance of patent expiry. Finally, the new rules should streamline procedures and reduce red-tape, while at the same time strengthening the supervision of pharmaceutical products. This is a tangible deliverable of the G-10 process initiated by the Commission and fully endorsed by the Competitiveness and Health Council under the Italian Presidency.

    [02] Douane et politique commerciale : la Commission ouvre un débat sur l'avenir des règles d'origine préférentielles

    La Commission européenne ouvre un large débat sur les règles d'origine appliquées dans les régimes commerciaux préférentiels avec la publication d'un document de consultation ("livre vert") à ce sujet. Ces régimes visent à accroître, à travers l'élimination ou la réduction des droits de douane, les échanges réciproques de marchandises ainsi que l'accès des produits des pays en développement au marché communautaire. Ils n'ont de sens que si ces préférences tarifaires s'appliquent aux produits effectivement obtenus dans le pays qui en bénéficie, à ceux qui en sont "originaires". Le Livre vert que la Commission vient d'adopter met en évidence l'évolution du contexte et des objectifs de ces régimes et l'impact de cette évolution sur la définition des règles d'origine. Une action s'avère indispensable dans trois domaines : la détermination de l'origine d'un produit, le contrôle de l'application loyale des règles d'origine et les procédures établissant les responsabilités respectives des opérateurs bénéficiaires des préférences et des autorités publiques. La Commission invite tous les milieux intéressés à contribuer d'ici le 1er mars 2004 à cet exercice de réflexion.

    [03] Commission clears acquisition of Svenska Glasskiosken by Nestlé AB and Ingman AB

    The European Commission has granted clearance under the Merger Regulation to the acquisition of joint control of the undertaking Svenska Glasskiosken AB, active in the sale, marketing and distribution of ice cream products in Sweden, by Nestlé Sverige AB and Ingman Glass AB (Finland). (The operation, notified on 19 Novembre 2003, was examined under the simplified merger review procedure)

    [04] Commission clears acquisition of Swedish bed maker Hilding by Investcorp

    The European Commission has granted clearance under the Merger Regulation to the acquisition of full control of the Swedish undertaking Hilding Anders AB by the Investcorp Group (Kingdom of Bahrain). Hilding Anders makes beds, mattresses and related products. Investcorp is an investment company. (The operation, notified on 19 November 2003, was examined under the simplified merger review procedure)

    [05] Third quarter 2003 compared to third quarter 2002 : Euro-zone labour costs up by 3.0% ; EU15 up by 3.2%

    Total hourly labour costs in the whole economy of the euro-zone grew by 3.0% in nominal terms in the third quarter of 2003 compared to the third quarter of 2002, Eurostat reports today. In the second quarter of 2003 the increase was 3.3%. For the EU15 the rise was 3.2% in the third quarter of 2003, compared to 3.3% in the previous quarter. Among Member States for which data are available, the smallest annual rise was in Germany and Portugal (2.5%) and the biggest in Finland (3.9%).

    [06] GDP per capita in purchasing power standards : acceding countries' GDP per capita 47% of the EU average in 2002 ; first results 2002, final data 2001, revised data 1995-2000

    According to a report issued today by Eurostat, first results for GDP per capita in 2002, expressed in terms of purchasing power standards (PPS), show that Luxembourg recorded a figure around 90% above the EU average, Ireland 25% above, and Denmark, the Netherlands and Austria a little more than 10% above average. Belgium, Germany, France, Italy, Finland, Sweden and the United Kingdom were around the average, while Spain was about 15% below, and Greece and Portugal about 30% below the EU average. Amongst the acceding countries, Cyprus was about 25% below the EU average, and the Czech Republic, Malta and Slovenia around a third below the EU average. Hungary was just above half the EU average, while Estonia, Latvia, Lithuania, Poland and Slovakia all recorded figures less than half the EU average.

    [07] Premières estimations pour 2003 : le revenu agricole réel par actif en hausse de 0,9% dans l'UE

    Dans l'UE, le revenu agricole réel par actif a augmenté de 0,9% en 2003 selon les premières estimations publiées aujourd'hui par Eurostat. Dans la zone euro, le revenu agricole par actif a baissé de 0,5%. La progression du niveau du revenu agricole réel par actif dans l'UE résulte d'une réduction du revenu agricole réel (-1,5%) qui a été plus que compensée par la diminution du volume de la main-d'œuvre agricole (-2,4%). Le revenu agricole se situe au-dessus des niveaux de 2002 dans sept Etats membres. Les augmentations les plus fortes ont été estimées au Royaume-Uni (+20,5%), en Belgique (+8,6%), en Espagne (+4,2%) et au Portugal (+3,3%). Les baisses les plus marquées du revenu agricole sont attendues en Allemagne (-14,2%), au Danemark (-7,9%), en Autriche (-6,4%) et en Finlande (-5,9%).

    [08] Statement of David Byrne on possible vCJD transmission by blood

    Following the information made available yesterday by the UK Secretary of State for Health, John Reid, about the possibility of transmission of variant Creutzfeldt-Jakob Disease (vCJD) through a blood transfusion, European Commissioner for Health and Consumer Protection David Byrne said that all the circumstances surrounding this tragic death needed careful examination before any firm conclusion could be drawn. At a meeting of the EU's Communicable Disease Network yesterday the UK Representative was requested to provide detailed information so that all concerned could examine the issue.

    [09] Libre circulation des marchandises : procédures d'infraction contre huit Etats membres

    La Commission européenne a décidé de saisir la Cour européenne de justice à l'encontre de la France pour non respect d'un arrêt précédent de la Cour lui enjoignant d'appliquer correctement une directive de 1985 relative à la responsabilité du fait des produits défectueux. Si la France persévère dans son manquement, la Cour peut imposer une astreinte quotidienne. La Commission saisit également la Cour à l'encontre de l'Allemagne pour son exigence de retrait immédiat du marché des importations parallèles de pesticides, sans ménager de période de transition pour la liquidation des stocks existants, si le produit de référence concerné est retiré du marché. La Cour sera saisie à l'encontre de la Belgique pour son exigence que les systèmes d'alarme déjà vendus légalement dans d'autres Etats membres soient spécifiquement agréés par un organisme belge avant de pouvoir être commercialisés dans ce pays. La Commission a d'autre part décidé de demander officiellement à la Finlande d'éliminer les obstacles injustifiés à l'utilisation temporaire sur le réseau routier de véhicules précédemment utilisés dans un autre Etat membre. Elle demandera à l'Espagne d'éliminer les restrictions à l'importation d'aérosols à fonction extinctrice. Les Pays-Bas seront tenus de mettre un terme à la restriction à la vente des échelles portables importées d'autres Etats membres ainsi qu'à l'interdiction de l'exportation des Pays-Bas de certaines espèces d'animaux empaillés. Des demandes officielles similaires seront transmises à l'Italie pour son interdiction d'immatriculer les remorques de motocycles et au Royaume-Uni pour le manque de critères clairs auxquels les feux de signalisation portables importés doivent se conformer. Les demandes de la Commission prennent la forme d'avis motivés, qui représentent la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. Si les autorités nationales ne répondent pas de façon satisfaisante dans un délai de deux mois, la Commission peut décider d'en référer à la Cour de justice.

    [10] Public procurement : Commission acts to ensure six Member States apply EU rules

    The European Commission has decided to act in thirteen cases to enforce EU law on public procurement. It has decided to refer Italy to the European Court of Justice over four cases involving the award of contracts to operate state owned betting establishments, to build two motorways and to manage computer services for the city authorities in Mantova. The Commission will refer the UK to the Court over the non-application of public procurement rules by providers of social housing. Austria will be brought before the Court over a contract for the collection and treatment of waste in the municipality of Mödling and Finland over the procurement without competition of kitchen equipment for government buildings. The Commission has also decided to formally ask Greece to rectify breaches of EU law linked to the supply of trains for the Athens Metro, technical assistance to farmers and consultancy services for the construction of a water purifying plant. Greece is also being asked to complete writing into national law the 2001 Directive on the use of standard forms for calls for tender. The Commission is requesting Italy to modify a national law allowing contracting authorities to extend existing procurement contracts without competition. Finally, the Commission is asking the Netherlands to rectify irregularities in the award of contracts to renovate the city centre of Hoogezand-Sappemeer. These formal requests take the form of 'reasoned opinions', the second stage of infringement procedures under Article 226 of the EC Treaty. In the absence of a satisfactory response, the Commission may refer the Member States in question to the European Court of Justice.

    [11] Libre circulation des services : procédures d'infraction contre l'Italie, le Luxembourg, la France, l'Espagne et l'Allemagne

    La Commission européenne a décidé de poursuivre six procédures d'infraction contre cinq Etats membres afin de mettre fin à des entraves à la libre circulation des services et à la liberté d'établissement. Ces entraves nuisent aux intérêts des entreprises et des citoyens européens. La Commission a décidé de rappeler à l'Italie et au Luxembourg leur obligation de se conformer aux arrêts de la Cour de justice européenne exigeant qu'ils modifient leurs législations en ce qui concerne les agents en brevets. La Commission saisira la Cour à l'encontre de la France en raison des restrictions pesant sur les agences de placement des artistes et sur les artistes indépendants désireux d'exercer leurs activités en France. Par ailleurs, la Commission a décidé d'envoyer une demande formelle, sous forme d'avis motivé, à l'Espagne de modifier sa législation en ce qui concerne le transfert de portefeuilles d'assurance entre opérateurs. Cette législation est, selon la Commission, discriminatoire à l'égard des assureurs des autres Etats membres. Dans le domaine de l'insémination artificielle de bovins, la Commission a décidé d'envoyer des avis motivés à la France et à l'Allemagne, dont les règles nationales empêchent ou découragent les opérateurs d'autres Etats membres d'exercer leurs activités. L'avis motivé correspond à la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. En l'absence d'une réponse satisfaisante dans un délai de deux mois, la Commission pourrait décider de traduire les Etats membres concernés devant la Cour de Justice.

    [12] Excise duties : Commission refers Germany to Court over taxation of "hand made" cigarettes

    The European Commission has decided to refer Germany to the Court of Justice for applying a lower rate of excise duty to rolls of tobacco from which consumers can make their own cigarettes. The Commission believes this practice breaches the EU's Excise Duty Directives, which require these products to be taxed like cigarettes, and distorts competition by allowing alternatives to ready-made cigarettes to enjoy lower taxes.

    [13] Commission agrees on the strategy to implement structural funds in new Member States for 2004-2006

    The European Commission confirmed today that the negotiations on the strategy for the implementation of structural funds in the ten acceding states for the period 2004 to 2006 have been successfully concluded. These negotiations have resulted in an agreement on the priorities for economic and social development strategy for the 10 that will be supported with community funding during the period 2004-2006. For this period, some €22 billion have been earmarked for all structural instruments in the 10 countries which join the EU on the 1 May 2004. The Treaty of Accession provides that the acceding countries may benefit from the eligibility of expenditure under structural funds as of 1 January 2004 where all the conditions laid down in the structural funds and cohesion fund regulations are fulfilled. The programming documents will only be formally approved upon accession on 1 May 2004.

    [14] Commission to sign key social inclusion agreements with accession countries

    The European Commissioner for Employment and Social Affairs, Anna Diamantopoulou, is to sign a Joint Memorandum for Social Inclusion (JIM) with a Minister from each of the EU's accession countries on 18 December. The documents represent a key advance in acceding countries' fight against social exclusion and poverty.

    [15] Commission opens delegation in Yemen

    On 18 December 2003, External Relations Commissioner, Chris Patten, and the Yemeni Ambassador at the EU, H.E. Mr Mohamed Jaffer, will sign the establishment agreement for the opening of a European Commission delegation in Sana'a, Yemen, from January 2004. The office in Sana'a will support development cooperation activities and implementation of the National Indicative Programme for Yemen, which represents the bulk of EC-Yemen bilateral relations. The establishment of the delegation will also help to strengthen cooperation in key areas of mutual interest such as human rights and democratisation.
