  • [01] Mise en œuvre du droit communautaire de l'environnement: une étude souligne de graves insuffisances

    Un rapport publié aujourd’hui par la Commission européenne révèle de graves insuffisances dans la mise en œuvre du droit communautaire de l'environnement. Ces carences privent les citoyens du degré élevé de protection de l'environnement auquel ils sont en droit de s’attendre. La cinquième étude annuelle sur la mise en œuvre et le contrôle de l'application du droit communautaire de l'environnement montre que les États membres ont pris du retard dans la transposition des directives: la fin de 2003, la Commission relève 88 cas dans lesquels les directives relatives l'environnement n’ont pas été transposées temps. Dans 118 cas, les directives n’ont pas été correctement transposées et, dans 95 cas, les États membres ont manqué aux obligations «secondaires» imposées par les directives, par exemple en ne respectant pas les délais pour la présentation de certains plans, la soumission de données ou la désignation de zones protégées. Le degré de conformité la législation varie d’un État membre l’autre, la France, la Grèce, l’Irlande, l’Italie et l’Espagne affichant les plus mauvais scores. C’est dans les secteurs de l’eau, des déchets, de la protection de la nature et des évaluations des incidences sur l'environnement que l’on enregistre le plus grand nombre de carences.

    [02] Green Paper on mutual recognition of non-custodial pre-trial supervision measures

    On 17 August the European Commission adopted a Green paper on mutual recognition, between the Member States of the European Union, of non- custodial pre-trial supervision measures, i.e. alternatives to pre-trial detention, such as reporting to police authorities, travel prohibition etc. The Green Paper will serve as a basis for discussions with practitioners about the preparation of a Commission proposal for a new EU law. The aim is to make it possible for a suspect arrested in an EU Member State in which (s)he is not resident to be subject to a non-custodial supervision measure in his or her EU Member State of residence, until the trial takes place in the arresting Member State. Presently, non-resident suspects are often remanded in custody, while residents benefit from alternative measures. Mutual recognition of non-custodial pre-trial supervision measures would reduce the excessive use and length of pre-trial detention, which is one of the main causes of prison overpopulation. It would also reinforce the right to freedom and presumption of innocence throughout the EU and decrease the risk of discriminatory treatment of non-resident suspected persons as compared to residents. The main objective of this Green Paper is to consult judges, prosecutors and defence lawyers, people working in the social and probation services, pre-detention establishments and prisons, professional organisations, academic circles, relevant NGOs and public authorities. The European Commission has already consulted experts and written a discussion paper based on replies to a questionnaire it had sent out, aimed at identifying obstacles to cooperation between Member States in this area.

    [03] Commission clears merger between Japanese pharmaceutical firms Yamanouchi and Fujisawa

    The European Commission has approved, under the Merger Regulation, the proposed merger between Yamanouchi Pharmaceutical Co., Ltd and Fujisawa Pharmaceutical Co., Ltd. The merger does not pose any competition concerns in the European Union.

    [04] Erasmus Mundus: extra funding for China

    The European Commission has approved €9 million of financing for the Erasmus Mundus China Window. This action will contribute to improving political, economic and cultural linkages between the EU and China. It will finance extra scholarships for Chinese students and scholars to study in the EU and partnerships between EU and Chinese universities under the global Erasmus Mundus programme.

    [05] Commission clears Alpinvest Partners/3i Group joint acquisition of CID Car Interior

    The European Commission has granted clearance, under the Merger Regulation, to the acquisition of Germany's CID Car Interior Design Holding GmbH by Alpinvest Partbers NV (Netherlands) and 3i Group plc (UK), respectively a financial investment and a venture capital firm (The operation, which was notified to the Commission on July 16, was examined under a simplified procedure).
