    [01] Pour un transport public plus efficace et de qualité

    La Commission européenne a adopté un projet de règlement sur les services publics dans le transport de passagers, qui vise à améliorer ses performances et sa transparence grâce à une concurrence contrôlée. Le nouveau cadre harmonisera des aspects clés des procédures de concurrence développées dans les différents Etats membres, et promouvra la sécurité juridique sur les droit et devoirs des opérateurs et des autorités par rapport au droit communautaire sur les aides d'Etat et les droits exclusifs. Il établira également une obligation explicite pour les autorités de veiller à la mise en place de services de transports en commun appropriés, afin d'assurer la plus grande qualité possible, de permettre l'intégration des services et de veiller aux intérêts des employés.

    [02] Commission clears merger of agrochemical businesses of AstraZeneca and Novartis, subject to substantial divestitures

    The European Commission has authorised the merger between the agrochemical businesses of Anglo-Swedish firm AstraZeneca Plc and Novartis AG of Switzerland to form Syngenta, the world's leading crop protection business. Regulatory approval is subject to a number of divestments offered by the companies to address concerns about the creation or strengthening of dominant positions on 39 markets for crop protection products, including cereal fungicides and maize herbicides. The commitments offered represent total sales worldwide in excess of euro 250 million this year and a potential euro 500 million in the near future, of which more than half in Europe.

    [03] La Commission comblera l'écart entre les tâches qui lui incombent et les ressources dont elle dispose

    A la suite d'un examen approfondi effectué par son "groupe de pilotage", la Commission européenne a adopté une stratégie de deux ans afin de combler l'écart entre ses tâches essentielles et les ressources nécessaires pour s'en acquitter dans le respect des normes d'excellence requises. Les deux tiers des besoins définis seront satisfaits grâce aux "dividendes de la réforme" engendrés par d'ambitieuses mesures internes, et notamment des gains d'efficacité, le redéploiement de personnel et des départs anticipés à la retraite. Le tiers restant sera obtenu par de nouveaux postes à demander parmi ceux qui sont prévus dans les perspectives financières existantes. L'opération se traduira par l'arrivée à la Commission de 1.000 visages nouveaux en deux ans soit un renouvellement de plus de 5% du personnel de la Commission et par la réaffectation de plus de 500 personnes à de nouvelles tâches. Les mesures relevant de l'efficacité exposées dans la stratégie du groupe de pilotage devraient aboutir à un gain de productivité de 16% au cours du mandat de l'actuelle Commission.

    [04] Commission wants to overhaul the management of its support programmes

    The European Commission wants to overhaul the management of its support programmes. Ultimately 99 of the 119 existing technical assistance offices (TAOs) are to disappear. In the field of external action in particular, an agency is to take over much of the work done by the TAOs. On Wednesday the Commission adopted a communication proposed by Ms Schreyer, the Budget Commissioner, on the impact of this policy on the 2001 budget. Pending the introduction of the new structures, and in particular the adoption of a legal basis for executive agencies, the Commission is proposing two transitional arrangements to be applied on a case-by-case basis: either the work will be taken over by temporary staff within the Commission; or the contracts of existing TAOs will be extended, where appropriate with some restrictions on the tasks assigned to them. The Commission will be sending the necessary proposal to the budgetary authority - Parliament and Council.

    [05] Commission partially rejects State aid for the purchase of commercial vehicles (RENOVE II)

    The European Commission has found that a Spanish aid scheme for the purchase of commercial vehicles in favour of recipients having transport as their main business, is incompatible with the common market, and orders the Spanish Government to recover the aid from the recipients. However, not all aid given under the scheme is considered illegal under EU law. In so far a recipient's main business is not transport and the vehicle is used only for own-account transports on a local or regional level, the Commission finds that the intra-community trade is not affected and the scheme does not constitute State aid within the meaning of the Treaty. Between 1 January-31 December 1997, Spain implemented a system of aid to encourage self-employed individuals and SMEs to scrap their old commercial vehicles and replace them with new ones. This system follows a cooperation agreement dated 26 February 1997 between the Ministry for Industry and Energy and the Official Credit Institute concerning the provision of a special line of credit for the purchase of commercial vehicles. However, the Commission considers that, as a whole, the aid system under which the aid could be awarded was constructed in a way that could distort or threaten to distort competition by favouring certain undertakings and affect trade between Member States, especially in the road transport sector. Consequently, the aid system cannot be allowed under EU rules. The Commission notes that the present decision is fully in line and consistent with its previous decision from 1 July 1998 concerning a similar Spanish aid scheme (Plan Renove Industrial- Renove I).

    [06] Commission proposes new basis for cutting noise pollution

    The European Commission has presented a proposal for a Directive on the Assessment and Management of Environmental Noise with the aim of providing a basis for a coherent, integrated EU policy on environmental noise. The proposal introduces measures to classify and understand the problems caused by noise, as a necessary step to preparing future concrete mesures to reduce noise pollution. The Commission is launching the idea of making EU- wide 'noise maps' based on common methods and indicators. These maps should be made available to the public. They should form the basis for development of action plans and strategies at local, national and EU levels to combat noise pollution.

    [07] Data protection : Commission adopts decisions recognising adequacy of regimes in US, Switzerland and Hungary

    The European Commission has adopted a Decision determining that an arrangement put in place by the US Department of Commerce known as the "safe harbor" provides adequate protection for personal data transferred from the EU. At the same time, the Commission has adopted similar Decisions concerning Switzerland and Hungary. The "safe harbor" arrangement, which as a result of this Decision will be fully up and running by November, is the fruit or more than two years of dialogue between the Commission and the US Department of Commerce. The dialogue was launched to head-off the possibility that data transfers to the US might be blocked following the entry into force in 1998 of the EU's Data Protection Directive, which provides that personal data can only be transferred to third countries providing "adequate protection". Under the "safe harbor", US companies can voluntarily adhere to a set of data protection principles recognised by the Commission as providing adequate protection and thus meet the requirements of the Directive as regards transfers of data out of the EU.

    [08] Commission adopts rural development programs for Austria, Finland, Italy and Sweden for 2000-2006

    The European Commission has adopted eight rural development plans for Austria, Finland (2 programs), Italy (4 regional programs), and Sweden. Financial aid of a total of euro 7469 million has been allocated for these rural development programs for the period 2000-2006.

    La Commission européenne a pris une décision à l'encontre d'un système de redevances d'atterrissage en vigueur dans les aéroports espagnols et qui constitue une discrimination en faveur des compagnies aériennes nationales. Elle a également adressé une lettre de mise en demeure aux autorités italiennes pour les informer de ses préoccupations concernant un système similaire de redevances d'atterrissage qui favorise les compagnies aériennes italiennes.

    [10] Commission clears Preussag's acquisition of Thomson travel

    The European Commission has cleared the acquisition by German company Preussag AG of UK travel company Thomson Travel Group Plc. The UK and Irish foreign package holiday markets are the only ones where the parties' activities overlap significantly, due to the combination of Thomson Travel and Preussag's partly owned Thomas Cook. In order to solve serious concerns about the creation of a collective dominant position in the UK market for short-haul foreign package holidays, Preussag committed itself to divest its interest in Thomas Cook. German bank Westdeutsche Landesbank (WestLB), which has links with Preussag, will also sell its stake in Thomas Cook. Subject to full compliance with the proposed divestments, the Commission concluded there was no longer a competition problem.

    [11] Libre circulation des biens : procédures d'infraction à l'encontre de la Belgique, de l'Autriche, de l'Espagne et des Pays-Bas

    La Commission européenne a décidé de poursuivre des procédures d'infraction à l'encontre de l'Espagne, des Pays-Bas, de la Belgique et de l'Autriche pour entraves injustifiées à la libre circulation des biens en violation du Traité CE (article 28). La Commission a décidé de saisir la Cour de justice contre l'Espagne, pour cause d'une interdiction absolue de circuler avec des motocycles tirant une remorque, et contre les Pays-Bas, pour sa réglementation relative à l'addition de nutriments aux denrées alimentaires. La Commission a également décidé d'adresser des avis motivés à l'Espagne (concernant les nettoyants contenant de l'eau de Javel), à la Belgique (matériel orthopédique) et à l'Autriche (produits pharmaceutiques). Un avis motivé constitue la deuxième étape de la procédure d'infraction (Article 226 du Traité CE). Si un Etat Membre destinataire d'un avis motivé ne fournit pas une réponse satisfaisante dans les deux mois qui suivent la réception de l'avis, la Commission peut saisir la Cour de justice européenne.

    [12] Services : la Commission décide d'envoyer un avis motivé à la Belgique concernant des restrictions portant sur un projet de fidélisation du consommateur

    La Commission européenne décide d'envoyer un avis motivé à la Belgique concernant son refus d'autoriser une campagne de fidélisation du consommateur offrant trois points pouvant être échangés contre des billets d'avion. La Commission considère que le refus constitue une restriction illégale à la liberté de prestation de services dans le marché intérieur. L'avis motivé constitue la seconde étape des procédures officielles en infraction conformément à l'article 226 du traité CEE. Si la Belgique ne fournit pas une réponse satisfaisante dans les deux mois à compter de la réception de l'avis motivé, la Commission peut décider de porter l'affaire devant la Cour européenne de justice.

    [13] Agents en brevets : la Commission décide de déférer l'Italie et le Luxembourg devant la Cour de justice

    La Commission européenne a décidé de déférer l'Italie et le Luxembourg devant la Cour européenne de justice concernant des restrictions sur les activités des agents en brevets. Les autorités luxembourgeoises et italiennes exigent des agents en brevets d'être domiciliés respectivement au Luxembourg et en Italie, une condition que la Commission considère comme une restriction injustifiée à la liberté de prestation de services contraire au traité CE (article 49).

    [14] Commission acts against UK, Germany and Belgium on public procurement rules

    The European Commission has decided to send "reasoned opinions" to the UK and to Germany and to refer Belgium to the European Court of Justice and incorrect application of the EU public procurement Directives. They lay down strict rules for the award of public contracts, including the obligation to follow open and competitive tendering procedures. In Belgium, the Flemish Regional Executive failed to publish an invitation to tender for an aerial survey of the Belgian coast. In two separate UK cases, contracts have been awarded by negotiated procedures in circumstances where the Commission considers that the conditions required by the Directives were not met. The German case concerns a contract awarded by the Region of Baden Württemberg for the construction of a police station complex in Singen without the publication at the EU level of an invitation to tender.

    [15] La Commission intervient contre les restrictions appliquées aux étrangers exerçant des activités d'agent de la sécurité

    La Commission européenne a décidé d'envoyer un avis motivé à l'Espagne concernant ce que la Commission considère comme étant des restrictions injustifiées sur l'aptitude de personnes n'ayant pas la nationalité espagnole à exercer l'activité d'agent privé de la sécurité en Espagne. La Commission estime que ces restrictions violent entre autres la liberté de prestation de service dans le marché intérieur. L'avis motivé constitue la deuxième étape des procédures officielles en infraction visées à l'article 226 du traité CE. Si l'Espagne ne fournit pas une réponse satisfaisante dans les deux mois à compter de la réception de l'avis motivé, la Commission peut décider de porter l'affaire devant la Cour européenne de justice.

    [16] Bathing water quality : Commission moves against Spain, the United Kingdom and Sweden

    The European Commission has decided to send a Reasoned Opinion (second warning letter) under Article 228 of the Treaty to Spain and to proceed to the Court of Justice against the United Kingdom and Sweden for non-respect of the Bathing Water Quality Directive. This action is part of a horizontal assessment of compliance with the Bathing Water Quality Directive.

    [17] La Commission prend des mesures à l'encontre de huit Etats membres dans le domaine des produits chimiques dangereux

    La Commission européenne a décidé d'adresser un avis motivé (deuxième lettre d'avertissement) à l'Espagne, à la France, à la Grèce, à l'Irlande, à l'Italie, au Luxembourg, au Portugal et au Royaume-Uni pour n'avoir pas communiqué à la Commission les informations requises en vertu de la directive sur les PCB. Les PCB sont des produits chimiques dangereux, très toxiques et persistants. Les huit Etats membres concernés n'ont pas communiqué à la Commission les inventaires et les plans relatifs au traitement des PCB, malgré un avertissement antérieur. L'échéance fixée à l'origine pour l'envoi de ces informations était le mois de septembre 1999.

    [18] South East Asia : Commission approves a disaster preparedness and prevention programme worth euro 4 million

    The European Commission has approved funding worth euro 4 million for programme disaster preparedness and prevention in South East Asia (Vietnam, Cambodia, Laos, Thailand, Philippines and Indonesia). The objective of this programme is to reduce the vulnerability of people most exposed to the threat of disasters in South East Asia. Operations are to be carried out at a national, regional, and local level. They focus on improving disaster response, improving coordination and raising awareness between communities, local institutions and civil protection bodies, including education and training information exchange and dissemination. Other operations cover strengthening the capacity of national institutes and Red Cross societies to respond to disasters (institutional and capacity building programmes) and developing pilot projects using low cost technology and local community participation to address forest fires and flooding. The DIPECHO programme was launched in 1996 by the European Commission Humanitarian Office (ECHO) to establish a regional and coherent approach to disaster preparedness and prevention. ECHO's role in the field of disaster preparedness and prevention is devoted to the promotion of actions leading to a reduction in disaster related risks of vulnerable people in developing countries. In 1999, DIPECHO funding for South East Asia amounted to euro 2.4 million.

    [19] Poul Nielson meets Hage Geinjob, Prime Minister of Namibia

    Today Prime Minister Hage Geinjob of Namibia meets with Poul Nielson, European Commissioner for development and humanitarian aid. The main purpose of the Namibian Prime Minister's visit is to discuss the issue of land reform in his country and how the EU can assist in this respect. The Commission will argue that successful land reform is key to the development of the country and that it be part of a strategy to eliminate poverty. Other issues regarding development of EU-Namibia cooperation will also be discussed.

    [20] Poul Nielson rencontre le Ministre du Commerce et de l'Industrie du Ghana

    Poul Nielson, Commissaire européen au développement et à l'aide humanitaire rencontre aujourd'hui Dan Abodakpi, Ministre du commerce et de l'industrie du Ghana. Les discussions porteront sur les conséquences de la récente approbation de la directive sur le chocolat pour les exportations de cacao du Ghana. Le développement des investissements directs au Ghana sera ainsi discuté à la lumière notamment des nouveaux instruments prévus dans le nouvel accord de Cotonou. D'autres points susceptibles d'être évoqués sont : l'appui à la réforme de l'administration et le problème de la dette.
